Models of Emergency Powers in Constitutional Law

Miguel Nogueira de Brito, partner of the Administrative and Public Law team at Morais Leitão, has published an article in e-Pública, an electronic journal of public law, entitled "Emergency models in constitutional law".

For the author, The understanding of the emergency powers exercised in recent times requires a critical review of the available models of exceptional powers in democratic constitutional experiences. After reviewing these models critically, this text seeks to understand, in the light of such models, the recent evolution in Portugal since the declaration of a state of emergency by the President of the Republic according to article 19 of the Portuguese Constitution.
