Legal Alert.AI | New regime for electricity-intensive customers: strengthening incentives for industry in Portugal

Morais Leitão has released a new edition of Legal Alert.AI, a podcast-style version 100% generated by artificial intelligence, focused on the new legal framework applicable to electricity-intensive consumption in Portugal.

This edition analyses Ordinance No. 203-A/2025/1, recently published, which introduces a new support scheme for electricity-intensive customers, with significant implications for the national industrial sector. The regime aims to foster greater competitiveness, ensure predictability in energy costs, and enhance alignment with the European Union’s environmental goals.

Key highlights of the new regime include:

  • Broader access, with a minimum consumption threshold of 1 GWh/year;
  • Stricter environmental requirements, with clear sustainability criteria;
  • Two cumulative support mechanisms:
    • Reduction of general economic interest tariff charges (CIEG);
    • Risk coverage in renewable electricity power purchase agreements (PPA);
  • Extension to recent installations, subject to a minimum four-year adhesion contract.
