In a commentary published in Nascer do SOL, Raquel Maurício, Coordinating Associate, and Francisco Loureiro Ferreira, Associate, analyse the impact of the new housing tax package, highlighting the importance of predictability and legal certainty to ensure effective results in the market.

The lawyers, who are members of the Tax practice, highlight the pragmatic nature of the tax relief measures as a positive sign, noting that, although subject to limits such as the sale price or rental value, they do not depend on complex reference values or the approval of urban policy instruments.

However, they argue that the effectiveness of the regime will depend on how it is implemented, warning of the need to strengthen legal certainty. As they state in their commentary, “it would be important to ensure even greater legal certainty. With regard to the reduced VAT rate, this would entail, in particular, clearly defining the responsibility of developers, without placing on them an excessive burden regarding the use that the purchaser makes of the property.”
